DUANE E. SHINNICK exclusively represents homeowners and homeowner associations in construction and design deficiency matters. He has a Bachelor of Science in Chemical Engineering from the Massachusetts Institute of Technology, a Master of Business Administration from the University of Chicago Graduate School of Business, and a Juris Doctor from the University of Chicago Law School. He has an extensive trial background, developed in the first 12 years of his legal career working for the San Diego County District Attorney's Office prosecuting criminal cases. Mr. Shinnick prosecuted over 100 jury trials and had a 100% felony trial conviction rate. He was the youngest deputy assigned to the Major Violator Unit and was elected President of the Deputy District Attorneys Association. Since 1986, he has focused on construction defect matters, successfully handling dozens of cases with recoveries in excess of 150 million dollars, including a $20.8 million settlement for the Leisure Village Ocean Hills Homeowners' Association.
The San Diego Trial Lawyers Association recognized Mr. Shinnick's exceptional trial work on Lake Park Terrace Homeowners Association v. Midway Homes and, in 1995, honored him with the Outstanding Trial Lawyer award. Mr. Shinnick has also served on the faculty of the National Institute for Trial Advocacy. He has been very active in drafting new legislation affecting consumer rights. Among his legislative projects, he assisted in the drafting and hearing process for Civil Code §1375, known as the "Calderon Statute." He speaks frequently about construction and design deficiency issues affecting homeowners' associations and community managers for groups such as the Community Associations Institute (CAI), Consumer Attorneys of California (CAOC), The Rutter Group, the Orange County Bar Association, and the San Diego County Bar Association. He is a past Chairman of the CAI Attorneys Roundtable.
